Terms of Service

These Terms govern your use of Foodium — the mobile app and this website, operated by Baland Tech, SL (see the Legal notice above). By creating an account or using Foodium, you accept these Terms. They have two parts: the Consumer terms apply to everyone who uses the app to discover places; the Business terms also apply if you subscribe as a venue. Some sections apply to everyone.

Your account

You sign in with Google or Apple; there is no anonymous use, and one person has one account. An account is either a consumer (diner) account or a business (venue) account, not both. You must give accurate information, keep your credentials secure, and be at least 16 years old to hold a consumer account. A business account holder must be an adult with authority to act for the venue. Usernames must be unique, at most 28 characters, and may not contain "foodium".

Consumer terms (using the app)

The Foodium app is free for diners. Features — discovery, swiping, reviews, saving, contacts and sharing — may change, and some content shown in the app is published by businesses. We make no promise that any feature will always be available.

You own what you create. By posting reviews, photos, notes or messages, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, adapt and distribute that content as needed to operate and promote the service. This licence continues for content that other users have already received or interacted with, even after you delete it or close your account. You are responsible for what you post; don't post anything unlawful, infringing or that you don't have the right to share. You can edit or delete your own content, and report content or places that shouldn't be there.

Business terms (venue subscriptions)

Claiming a venue is first-come, first-served and based on your own declaration — we do not verify ownership documents. When you claim a place, you confirm that you are the owner or an authorised manager. Misrepresentation may result in account removal and legal action. If a place is already claimed, you can raise a dispute; we review disputes and resolve them as quickly as we can, typically within a few business days, at support@foodium.app.

Business content publishes immediately, without editorial pre-approval. When you override your venue's details (name, hours, contact, price, summary, menu highlights) or publish photos, they go live subject only to ownership, an active subscription and basic validation. You warrant that this content is accurate and that you hold the rights to the photos you upload (including any necessary permissions for people or property shown). We may remove or correct business content, and we disclaim responsibility to diners for business-provided information. Base venue data may come from third-party sources and its accuracy is not guaranteed.

Paid photos may be given priority in the discovery feed. Your subscription is a subscription to a hosted service; it is not a payment to rank above other venues in search results.

Subscriptions, prices, the free trial, renewal, cancellation and refunds are set out in the Purchase conditions, which form part of these Terms. In short: plans are shown at checkout after you sign in; billing is monthly in advance in euros; you can cancel any time with access to the end of the paid period; and amounts already billed are non-refundable. Team members you invite have access until you remove them, your subscription ends, or you delete your account.

Reporting content and moderation

If you believe content on Foodium is illegal or breaches these Terms, tell us at contact@foodium.app and we will review it and act where appropriate. We may remove content, or limit or suspend accounts, that break these Terms or the law, and where we act on those grounds we'll give the affected user a reason where required.

Managing the service

We may change, add or withdraw features; run automated processes that release places, deactivate photos or refresh venue data; adjust how content is prepared and ranked; and change prices for future billing cycles. The app may update itself automatically, including applying code updates in the background. When AI features are enabled, we may process business content to provide them.

Intellectual property

Foodium, the Foodium name and logo, and the software and design of the app and site are ours or our licensors'. These Terms don't give you any rights in them beyond using the service. Our brand line "Make it yours" is used in English throughout.

Warranties and liability

Foodium is provided "as is", without warranties, and we don't promise it will be uninterrupted or error-free. AI-generated insights are advisory and may be imperfect. To the fullest extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim (consumer users pay nothing). Nothing here limits liability that cannot be limited by law.

Ending your use

You can stop using Foodium and delete your account at any time; deletion is described in the Privacy Policy. We may suspend or end access for breach of these Terms or misrepresentation. For venues, closing your account cancels the subscription immediately with no refund, and claimed places enter a grace period before they are released.

Governing law and changes

These Terms are governed by the law of the Principality of Andorra. We may update them; for significant changes we'll give reasonable notice.
